Current Status: District court decision upheld by Iowa Court of Appeals on July 8, 2022. Appellantsβ Application for Further Review granted by Supreme Court November 3, 2022. NextEra motion to file amicus curiae granted. Oral argument was held February 21, 2023. The Supreme Court reversed the decision made in District Court and remanded to the District Court on the merits. Supreme Court denied State and Intervenors' (ITC Midwest and MidAmerican) petitions for rehearing April 26, 2023.
